Maternity leave in Colombia

Maternity leave in Colombia means the recognition by the state of the rights of working mothers during pregnancy and childbirth.

The aim of maternity leave is to help the working mother to have time for the care of the newborn, but it also provides the possibility of resting before the moment of delivery.

Maternity leave has a total duration of 14 weeks, enjoying one or two weeks before delivery and the remaining 12 or 13 after the baby is born. Although if the delivery is early and the rest period before giving birth has not been enjoyed, the entire 14 weeks after delivery will be enjoyed. In addition, once they return to their job, mothers will enjoy a breastfeeding period for which they are entitled to two 30-minute breaks during the first 6 months of the baby's life.

Another of the rights of Colombian mothers is to enjoy their full salary during the time they are under the protection of maternity leave. If the amount of the salary is variable, the General System of Social Security in Health will average the income from the previous year and the result will be the salary that will be received during the period of maternity leave.

Working women who become pregnant, working mothers who decide to adopt a child under 18 years of age, and parents, without a spouse or partner, who adopt a child under 18 years of age, are the beneficiaries of maternity leave. But with regard to salary, they must have contributed at least during the time of the pregnancy and have no debts with the Health Service Provider Institutions, since in such case the right to collect maternity leave is lost.

The first thing is to inform the employer through a medical certificate of the pregnancy situation, which includes the possible date of delivery, since the employer is in charge of processing the maternity leave, since if it does not occur, he would be in charge to pay the salary of the working mother during the entire period of maternity leave.

Subsequently and once the 36th or 37th week of pregnancy has arrived, the IPS doctor must be requested for the antepartum leave that recognizes the right to rest for 1 or 2 weeks, at the option, before the baby is born.

Finally, once the baby is born and registered in the Civil Registry, the document must be presented to the IPS doctor to request the 12 or 13 week postpartum leave.
